The employee in question alleged his supervisor had repeatedly abused him, including lifting his bum and farting on or at him on a daily basis.
Filing an unfair dismissal case after he was made redundant, he said the nasty flatulence had resulted in depression, anxiety and physical injuries (loss of sense of smell?)
But Victoria’s Supreme Court has rejected his bid with the judge ruling that office farting is not bullying – and just part of our unique Aussie humour.
“I do not accept the plaintiff’s evidence about the frequency of Mr Short’s flatulence in the office or that it was targeted at the plaintiff,” she wrote in the judgement.
The court had heard the employee labelled the supervisor “Mr Stinky” and at one point sprayed him with deodorant.
We think he should have just pulled the classic workplace prank and ‘tin foiled’ his desk (trust me, it’s a thing. See above!)
